Billing Policy

This policy outlines how Fifth Ocean determines fees and charges, and performs billing.

Service Fee

Your SmartForms service has a fee denominated in the currency selected by the user upon sign-up.

Service fee is always paid in advance.

Invoice Frequency

Invoices are generated once a month and can be downloaded from your SmartForms account.

Failed Payments

SmartForms uses automated billing service. Should automatic payment fail the following process will take place:

  1. Email notification with an electronic invoice is issued to an account holder;
  2. If the payment has not been received by the due date on the invoice the SmartForms service is automatically suspended;
  3. If the payment has not been received within 4 weeks from the due date the SmartForms service will be automatically cancelled.

Taxes

Other than federal and state taxes imposed on Fifth Ocean in Australia, you are responsible for paying all taxes, duties, and other governmental charges ("taxes"), pursuant to the Fifth Ocean Terms of Service. You will pay any additional amounts as are necessary to ensure that the net amounts received by Fifth Ocean after all such taxes are paid are equal to the amounts that Fifth Ocean would have been entitled to if the taxes did not exist.

Changes to this Policy

Fees and charges for SmartForms Service will be effective when we post updated fees and charges on Pricing page.

Existing accounts are not subject to a price change for the minimum term of 6 months.

In the event of price change Fifth Ocean will give you at least 30 days' advance notice before the beginning of the billing cycle in which such change will take effect.
